1. Definitions
(a) “Company” refers to Clarin Electrical Services trading as Claddagh Solar.
(b) “Client” refers to the person or organization requesting work to be carried out by the Company.
2. Scope of Work
(a) All work shall be performed as per the agreed specifications in the contract or quotation provided.
(b) Any variations or additional work requested will require a written agreement and may incur additional charges.
3. Compliance with Regulations
(a) All work will comply with applicable Building Regulations and NSAI I.S.10101 standards in force at the time of the work. This ensures legal obligations, particularly for residential installations, are met.
(b) Any deviations from regulations must be requested in writing by the client, and a record will be maintained.
4. Risk and Title of Goods
(a) Risk in goods passes to the client upon delivery.
(b) Title of goods remains with Clarin Electrical Services until full payment is received.
5. Warranty
(a) Electrical installations are warranted to be defect-free for 12 months from the invoice date, provided no third-party alterations are made.
(b) Solar PV system installations are warranted as follows:
- Panels: 30-year manufacturer’s warranty.
- Panel Output: 25-year performance warranty.
- Electrical Products: 10-year warranty.
- Installation: 5-year warranty.
(c) Warranties do not cover physical damage or goods not supplied by the Company.
6. Payment Terms
(a) Full payment is required upon completion unless otherwise agreed in writing.
(b) A booking deposit of 30% or an agreed amount is required prior to work commencing.
7. Cancellation and Refunds
(a) Cancellations must be made in writing. Refunds will be processed based on the stage of work completed.
8. Liability
(a) The Company is not liable for delays caused by circumstances beyond its control, including but not limited to supply chain disruptions or weather conditions.
(b) Liability is limited to the value of the contract.
9. Dispute Resolution
(a) Any disputes will be handled through mediation before legal action is taken.
10. Governing Law
(a) These terms are governed by the laws of Ireland.
